Declan has a broad commercial practice, and accepts briefs to appear in all civil courts and tribunals.
Declan has particular expertise in competition and consumer law. He has appeared as counsel in a number of recent leading cases in this area, including for Metcash in relation to its acquisition of Franklins supermarkets (both at trial and on appeal), for AGL in relation to its acquisition of Macquarie Generation (before the Competition Tribunal), and for Woolworths in litigation against the ACCC in relation to fuel shopper dockets. Declan also regularly advises clients in this area, and assists clients in relation to investigations conducted by the ACCC. He has also acted for the ACCC, including in relation to Garuda’s claim for sovereign immunity from the ACCC (determined by the High Court in PT Garuda Indonesia Ltd v ACCC (2012) 247 CLR 240).
Declan’s broader commercial practice includes corporations law and insolvency, equity and property, class actions and regulatory disputes. Recent cases in which Declan has appeared include Chand v Commonwealth Bank of Australia  NSWCA 181 (in which he appeared for the CBA, successfully resisting a contractual and negligence claim against the Bank), and a class action on behalf of Volkswagen owners. Declan is regularly briefed to appear unled, in a variety of jurisdictions.
